Historic Photos Use and Fee Policy



COMMERICAL, DOCUMENTARY, AND EDITORIAL USE

Commercial Use:  is defined as the use of copies of historical photographs, film footage, or other visual images from the collections of the Kern County Museum with the chief emphasis of that use being the saleability and the potential for profit and success of the materials in questions.  Commercial use shall include, but not be limited to sale, resale publishing broadcast, and/or business decoration.  An Agreement for Non-Private Use of Historic Photographs must be signed.

Documentary Use:  is defined as the use of copies of historical photographs, film footage, or other visual images from the collections of the Kern County Museum for the portrayal, description, or presentation of actual events in the past or of actual current events.  Documentary use shall include, but not be limited to, factual reenactment of historical events, historical background information for current events, and/or newsworthy events.  Use fees apply if the user is NOT a member of the news media or press.  (please refer to press use).  An Agreement for Non-Private Use of Historic Photographs must be signed.

Editorial Use: is defined as the use of copies of historical photographs, film footage, or other visual images from the collections of the Kern County Museum for the purpose of enhancing, illustrating, or other wise embellishing any presentation of the opinion, text, or commentary of the user.  Fees apply if the user is not a member of the news media or the press (please refer to press use).  An Agreement for Non-Private Use of Historic Photographs must be signed.

EDUCATIONAL USE

Educational Use:  is defined as use of historical photographs, film footage, or other visual images from the collection of the Kern County Museum for the purpose of presentation within the context of a structured, educational program and with the intent of imparting or acquiring knowledge.  Educational use includes, but is not limited to, textbooks and filmstrips.  An Agreement for Non-Private Use of Historic Photographs must be signed.

PRIVATE AND PRESS USE

Private Use:  is defined as the use of historical photographs, film footage, or other visual images from the collections of the Kern County Museum for the private use, personal collection, and/or display within the confines of a residential dwelling.  Copyright to all photographs is retained by the Kern County Museum, so any photographs released under a personal use agreement cannot later be used for commercial, editorial, educational, or documentary purposes.  An Agreement for Private Use of Historic Photographs must be signed.

Press Use: is defined as any use by bona fide employees of the news gathering media who are gathering photographs at the Kern County Museum for the purpose of the news story.  Freelancers are not included as members of the press by this definition.  An Agreement for Private Use of Historic Photographs must be signed.
